1. Volunteering.
I am volunteering by my own choice to help build, operate, and/or perform in the Miner's Revenge haunted attraction and related events (the "Event"), produced by Scare Company Productions LLC ("Scare Company"). I am not an employee and will not receive wages or benefits.
2. What the work involves.
Volunteer work may include set construction and teardown; hand and power tools; ladders, heights, and heavy lifting; paint, adhesives, fog fluid, and theatrical makeup or prosthetics; electrical, pneumatic, and special-effects equipment; working outdoors at night; and performing as a scare actor in dark, foggy, confined spaces with strobe lights and loud sounds. I understand that frightened guests can react unpredictably and that performers may be struck, grabbed, pushed, or knocked down.
3. Assumption of risk.
I understand these activities can be dangerous and could result in personal injury, illness, property damage, or death. I KNOWINGLY AND FREELY ASSUME ALL RISKS of volunteering, known and unknown, including risks arising from the ordinary negligence of the Released Parties.
4. Release of liability.
TO THE FULLEST EXTENT PERMITTED BY LAW, I RELEASE, AND AGREE NOT TO SUE, Scare Company Productions LLC and its owners, staff, and volunteers; the San Benito County Fairgrounds / Bolado Park Event Center and its owners and operators; and Event sponsors (together, the "Released Parties") FROM ANY CLAIM FOR INJURY, LOSS, OR DAMAGE ARISING OUT OF MY VOLUNTEERING, INCLUDING CLAIMS BASED ON A RELEASED PARTY'S ORDINARY NEGLIGENCE. This release binds me, my family, heirs, and legal representatives.
5. Medical.
I consent to receiving first aid and emergency medical treatment if needed, at my own expense. I understand no medical, disability, or workers' compensation coverage is provided to me. I believe I am physically able to participate safely, and I have listed below any medical conditions or allergies (including latex or makeup allergies) the crew should know about.
6. Safety rules.
I agree to: attend safety briefings and follow crew-lead instructions and posted rules; use required safety equipment; use only tools and equipment I have been authorized and shown how to use (volunteers under 18 do not use power tools or work at height); report all injuries, near-misses, and unsafe conditions immediately; and never volunteer or perform under the influence of alcohol, cannabis, or drugs, or bring weapons on site.
7. Performing.
I will never intentionally touch, grab, or restrain a guest. If a guest becomes aggressive, ill, or distressed, I will break character and get a crew lead or security. I may stop volunteering at any time, and Scare Company may end my participation at any time for any reason.
8. Photos & video.
Builds, rehearsals, and show nights may be photographed or recorded. I give Scare Company permission to use my image, likeness, and voice in that material for promotion and marketing, in any media, without payment.
9. Keep the secrets.
During the season, I will not publicly share behind-the-scenes photos or details of scares, layouts, or effects without permission — the surprise is the show.
10. Other terms.
This agreement is governed by California law, with venue in San Benito County. If any part is found unenforceable, the rest remains in effect. I have read this entire agreement, I understand it, and I accept it freely and voluntarily.
